Terms and Conditions of Use of the Saint-Etienne Tourisme & Congrès media library

Use of the media.saint-etienne-hors-cadre.fr media library is reserved for those promoting Saint-Etienne Métropole as a tourist destination.

These terms and conditions of use are expressly subject to the provisions of the French Intellectual Property Code.

The purpose of the terms and conditions below is to govern the use of visuals, videos or any other creative works acquired by Saint-Etienne Tourisme & Congrès.

Article 1: Access to the media library

The "Free access" section allows any user to access the media library free of charge.

This section consists of a limited, pre-defined selection of photographs, chosen by Saint-Etienne Tourisme & Congrès. Any user interested in gaining wider access to the content of the media library, under the conditions set out below, must create an account. To do this, the User must apply to register via the form in the "Registration" tab, completing all the mandatory fields. The creation of the account only becomes effective after Saint-Etienne Tourisme & Congrès has validated the application.

Saint-Etienne Tourisme & Congrès reserves the right to refuse any application it chooses, without giving grounds, merely notifying the user concerned.

There are different categories of users (listed below) who may create an account. When creating an account, the user must indicate which category they belong to:

  • Press
  • Tour operator/Coach tour company
  • Institutional partner
  • Events organiser
  • Partner
  • Other (anyone who does not fall into one of these categories).

The scope of the rights in the content granted to the user varies according the category they belong to, after they have created their account as explained below.

If Saint-Etienne Tourisme & Congrès validates a user's application, the account will be created and the user will receive an e-mail confirming their registration, which will then allow them to access the content concerned through the media library, depending on which category they belong to.

Saint-Etienne Tourisme & Congrès reserves the right to close any account for which the information provided by the user appears erroneous, incorrect or out of date, at any time.

Article 2: Account information & RGPD

The user undertakes to keep their login and password secret in all circumstances and not to disclose it to any third parties. The user will be liable for any use of their login and password and for any resulting use/exploitation of the photographs. If the confidentiality of the login and password is no longer guaranteed, the user undertakes to inform Saint-Etienne Tourisme & Congrès immediately.

Any personal information that the user provides to Saint-Etienne Tourisme & Congrès on the media library site in response to the requests for information in connection with the opening of an account, will be collected and processed fairly and legally and will only be used for purposes linked to the media library, in accordance with the General Data Protection Regulation (GDPR).

All users are therefore entitled to download or delete their personal data whenever they wish, Saint-Etienne Tourisme & Congrès being obliged to delete all the data concerning them, if requested. To do this, the user may go click on "My account " once connected. You may then exercise your right of access to your data and have them modified or deleted at any time. You can delete your account by contacting us, enclosing a copy of proof of identity, by email at donneespersonnelles@saint-etiennetourisme.com.

Article 3: Making available & use

Saint-Etienne Tourisme & Congrès holds the rights to use the photographs loaned. However, it may not be held liable for any action, proceedings, claims or demands on the part of any person, in particular with regard to the image of a person featuring incidentally in an image, or to the production, reproduction, publication, telecommunication and dissemination to the public by the user of one or more photographs that they have reframed or otherwise modified.

The user undertakes to take up the cause of and to indemnify Saint-Etienne Tourisme & Congrès in the event of any action, proceedings, claims or demands relating to any improper or prohibited use of photographic visuals under this contract on the occasion of the loan of any photographic visual.

The photographic visuals made available by Saint-Etienne Tourisme & Congrès are the property of the author or their rights holders, and the borrower may only acquire the right of reproduction and/or communication to the public. These photographic visuals cannot be sold, but only and exclusively loaned.

Furthermore, the user undertakes to comply with any indications and restrictions specified in the captions of photographs included on the media library website.

All uses for purely commercial purposes are excluded (postcards, advertisements, space buying, posters, etc.).

Article 4: Modifications

Any modification of any nature whatsoever, in any form or by an process, is prohibited except with the prior written agreement of Saint-Etienne Tourisme & Congrès.

Article 5: Obligatory use of photo credits & time limit on use

The author's moral rights are inalienable and all visuals published must be accredited in the following form: "© Photographer's name/Saint-Etienne Tourisme & Congrès" easily visible, legible characters.

Each visual is subject to a time limit on the rights which is mentioned in the caption. Any use after that date is strictly prohibited. Saint-Etienne Tourisme & Congrès shall not be held liable for the use of any visual beyond that date.

Article 6: Applicable law, jurisdiction and contract documents

These terms and conditions of use are governed by the currently applicable law in France. Any use that does not comply with the terms and conditions of use of the Saint-Etienne Tourisme & Congrès media library may be the subject of legal action before the courts of competent jurisdiction.

These terms and conditions of use and restrictions are liable to change. The user must read them to check for any changes on each use.
